Terms of Service

Optimized Growth provides done-for-you digital marketing services for local businesses. This includes website design and development, ad campaign management (Meta Ads, Google Ads), content production, SEO, email automation, CRM integration, booking funnels, and related services as described on our service pages.

The specific scope of work for each client is defined in a separate service agreement. These terms apply to all engagements with Optimized Growth.

We guarantee a minimum number of qualified leads or bookings within the first 30 days of campaign launch. The specific number varies by industry vertical and is stated clearly in the service agreement before you commit.

If we do not meet the guaranteed number within the first 30 days, we continue working at no additional monthly cost until the guarantee is met. We do not stop working until the commitment is delivered.

The guarantee applies to the ongoing monthly management fee only. It does not apply to the one-time setup fee, which covers real labor already performed.

The setup fee covers the initial build of all assets required to launch your acquisition system. This includes your website or landing pages, brand system, conversion funnel, automations, ad creative, and tracking infrastructure.

This fee is non-refundable once work has begun. The reason is straightforward: the setup fee pays for labor and deliverable creation that cannot be undone once delivered. If work has not yet started, a full refund is available upon request.

The monthly fee covers ongoing campaign management, optimization, content production, reporting, and support. This fee is billed monthly at the start of each billing period.

The monthly fee is separate from any advertising spend (see Advertising Spend below).

Any advertising spend on platforms such as Meta Ads or Google Ads is separate from our fees and runs directly through the client's own ad account. The client retains full visibility and control over their ad spend at all times.

We manage the campaigns but we do not control or handle the ad budget directly. The client funds their own ad account.

Services are provided on a month-to-month basis after the initial setup period. Either party may cancel the engagement with 30 days written notice sent to chinmay@optimizedgrowth.com.

There are no cancellation fees and no long-term contracts. We earn your continued business every month.

All assets built during the engagement belong to the client. This includes the website, brand materials, landing pages, email templates, ad creative, and any other deliverables produced during the engagement.

If the engagement ends for any reason, the client retains full ownership of everything we built. We will transfer access to all accounts and files promptly upon request.

We treat all client business information as strictly confidential. This includes revenue figures, lead numbers, strategies, and any other business details shared with us in the course of delivering services.

We will not reference the client relationship in case studies, testimonials, or any public materials without explicit written permission from the client.

To deliver results, we need a few things from you:

• Timely access to ad accounts, your website, and any relevant platforms
• Accurate information about your business, pricing, and offer
• Prompt feedback on creative and copy during the setup phase
• A reasonable response time to leads generated by the system

Our guarantee is contingent on reasonable cooperation from the client. If delays in cooperation prevent campaign launch or performance, the guarantee timeline adjusts accordingly.

Our liability to you is limited to the total fees paid for the specific services in question. We are not liable for indirect, incidental, or consequential damages, including lost revenue or lost business opportunities.

Advertising platforms (Meta, Google) are third-party services outside our control. We are not liable for platform policy changes, account suspensions, or changes to ad delivery that are outside our control.

These terms are governed by the laws of India. Any disputes arising from these terms or our services will be resolved through arbitration in Pune, Maharashtra, India, in accordance with applicable arbitration rules.

We may update these terms from time to time. When we do, the updated date at the top of this page will reflect the change. Continued use of our services after an update constitutes acceptance of the revised terms.

For significant changes that affect active client agreements, we will notify affected clients directly.
